Terms of Service

Welcome to VayChat. These Terms of Service (the “Terms”) are an agreement between you and VayChat (“VayChat”, “we”, “us”) and govern your use of the VayChat mobile application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What VayChat is

VayChat is a community messaging app: you can exchange direct messages with other people and take part in public channels. Messages can include text, photos, and voice messages. The Service is currently provided free of charge.

2. Who may use VayChat

You must be at least 13 years old to use VayChat. If the law of your country requires a higher minimum age — or a parent’s or guardian’s consent — for using services like this one or for the processing of your personal data, you may only use VayChat if you meet that requirement.

3. Your account

• You sign in with your email address and a one-time code. Keep access to your email account secure — anyone able to read your email can sign in as you.
• You are responsible for the activity that happens through your account.
• Your @username must not impersonate other people or organizations and must not be misleading or offensive.

4. Acceptable use

VayChat has no tolerance for objectionable content or abusive behavior. You agree not to use the Service to:

• post or share content that is illegal, or that promotes or facilitates illegal activity;
• harass, threaten, bully, or defame others, or incite violence or hatred against any person or group;
• share sexual content involving minors in any form — this results in immediate account termination and, where required, a report to the authorities;
• impersonate any person or organization, or spread deliberate disinformation;
• send spam or unsolicited advertising, or operate bots without our permission;
• distribute malware or phishing content, or attempt to gain unauthorized access to the Service or other users’ accounts;
• scrape, harvest, or collect other users’ data or content.

5. Your content

You keep all rights to the content you post. So that we can operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, host, transmit, and display your content — solely for the purpose of providing the Service to you and the people you share it with. You are responsible for the content you post and must have the necessary rights to share it.

6. Moderation, reporting, and blocking

• You can report messages and users directly in the app, and block any user at any time.
• We review reports and act on them within 24 hours, including removing content that violates these Terms and ejecting the users responsible.
• We may remove any content and suspend or terminate any account that violates these Terms or puts other users at risk.

7. Ending your use of the Service

• You can delete your account at any time in the app (Profile → Delete account). Deletion is permanent: your account and profile are removed, your messages in direct conversations may become unavailable for both participants, and your channel messages are detached from your identity. • We may suspend or terminate accounts that violate these Terms.

8. Disclaimers and liability

The Service is provided “as is” and “as available”, without warranties of any kind, to the extent permitted by law. We do not control and are not responsible for content posted by users. To the maximum extent permitted by law, VayChat is not liable for indirect or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law (including, under German law, liability for intent, gross negligence, and injury to life, body, or health), and your mandatory statutory rights as a consumer remain unaffected.

9. Changes

We may update the Service and these Terms. If we make material changes to these Terms, we will announce them in the app. If you continue using the Service after a change takes effect, the updated Terms apply.

10. Governing law

These Terms are governed by the law of the Federal Republic of Germany. If you live in another country, the mandatory consumer-protection rules of your country of residence remain unaffected.
